I, Jacob Lane, Sr. being desirous of locating the NWW of the SE gr and E 1/2 SW gr & SW gr SW gr in Township No. 20 North of Range No. 10 West, Ill, with the attached Military Land Warrant Certificate, No. 55013 issued under the provisions of the ninth Section of the Act of Congress, approved February 11th, 1847, do solemnly swear that from my own knowledge of the fact, after actual inspection of the said tract of land, on or about the 22nd day of October of said land, except my own nor was there any person or persons residing upon it; ----- And I do verily believe that there is no actual settlement and cultivation except My own or any person or persons residing upon any part of said land at this time.

It is hereby certified, that the Land Warrant No. 55,013 for 160 acres, Polly Ann Rector & Christina Rector, Children & heirs at law of David M. Rector, dec'd, Private in Capt. Scantland, Company 4th Regt. of Tennessee Volunteers under the date of April Seventeenth 1849 and will be deposited in the General Land Office, at the Seat of Government; and that, pursuant to the provisions of the subjoined ninth section of the Act of Congress, approved on the 11th day of February, 1847, entitled "An act to raise for a limited time an additional military force, and for other purposes," this Certificate of right to locate said warrant on any Quarter Section of land subject to private entry, will be received at any of the Land Offices of the United States, under the regulations and restrictions set forth in the accompanying statement of the Commissioner of the General Land Office.
After the location of this Certificate, it is to be surrendered to the General Land Office, whence the PATENT will issue.

Washburn is appointed guardian to Polly Ann Rector and Christiana Rector minor orphans who came into open court together with John Leach and Henry Taylor his security and executed bond in the sum of one hundred Dollars conditioned as the law directs for his faithful performance whereupon said bond duly approved by the court and ordered to be recorded.

Expartee petition to sell land warrant
In this case it is ordered by the court that the matters set forth in the petition be referred to the clerk of this court that he take proof and report thereon to the present term of this court upon the propriety of selling said land warrant in the pleedings mentioned.

Be it remembered that this cause came on to be heard on this 3rd day of March 1851 and was heard before the worshipful county court of Jackson County upon petition proof and report of the clerk which is in the ward and figures (to wit) In this case the clerk of the County Court reports to the worshipful court that in pursuance to a decreth order made in this case at the present term that he has proceeded to take the Deposition of George M. McWhirter and Thomas H. Butler from which it appears that it would be manifestly to the interest of all persons concerned that said land warrant be sold for distribution and that one hundred and ten dollars is a fare cash price for said land warrant all of which is respectfully submitted and the court before the proof in this cause.

Which report being unexpected is in all things confirmed by the court. It is ordered adjudged and decreed by the court that said Land Warrant No. 55013 for 160 acres be sold to the highest bidders for cash at the Court house door in Gainesboro and the clerk of this court proceed to sell the same after giving at least 20 days notice by advertisement at three or more public places in Jackson County one of which shall be at the court house door in Gainesboro and that the biddings for said land warrant be opened at one hundred and ten dollars all other matters being reserved untill the coming in of said report.

Be it remembered that this cause came on again to be finally heard on this 7th day of April 1851 before the worshipful court of Jackson County upon the report of the Clerk of said court which report is unexcepted to and is in the following words and figures (to wit).
Sarah Rector & B. B. Washburn guardian to Polly Ann Rector & Christania Rector Expartee Report
In this case the clerk of the county court of Jackson County respectfully reports to the worshipful county court of said county that in pursuance to an interlocutory decree herein pronounced at that March Term 1851 he preceded to sell said Land warrant No. 55013. for 160 acres Issued from the Commissioners of Pensions at Washington City D. C. on the 17th day of April 1849 to Sarah Rector widow & Polly Ann Rector & Christina Rector children and heirs at law of David M. Rector (decd) to the highest bidder for cash at the court house door in Gainesboro after having advertised the same as direct in said Decreth order when Benjamin B. Washburn became the purchaser at the price of one hundred and ten dollars he being the highest and best bidder and it being the minimum value of said land warrant all of which is respectfully submitted Mart the 29th 1851.

Whereupon it is ordered and decreed by the court that said report be in all things confirmed and that the Title of Sarah Rector widow and Polly Ann Recter & Christina Recter children and heirs at law of David M. Recter in and to said Land warrant be forever divested and vested in the purchaser Benjamin B. Washburn and that the cost of sale be pair out of the fund arising from the sale and that the clerk pay over to said fund to those entitled.

DECLARATION OF WIDOW FOR PENSION

On this 23rd day of January, A. D., 1888, personally appeared before me, clerk a clk of Court of Record, of a Court of Record [sic] in the State, of Tennessee Sarah Rector, a resident of Gainesboro in the county of Jackson in the State of Tennessee, who being by me first duly sworn according to law, deposes and says:
I am the widow of David M. Rector, who served under the name of David M. Rector, as a Private in the company commanded by Captain John Scanland, in the 4 regiment of Tenn Volunteers Infantry commanded by Col Richard Waterhouse, in the war with Mexico; That my said husband enlisted at Gainesboro Tenn on or about the ____ day of _____ 1847 for the term of 12 months; That I was married under my name of Sarah Taylor to my said husband, by Manon Anderson on or about the ____ day of ______ 1843, at my mother's house, in the state of Tenn, and lived with my said husband from the date of my said marriage until the day of his death, to wit: the 15th day of March, A. D., 1848, when my husband died at in the service in the State of Mexico, and that I have not since remarried, That there was never any legal impediment to said marriage.
No. 1. That my said husband being duly enlisted, as aforesaid, actually served sixty days with the Army or Navy of the United States in Mexico, or on the coast or frontier thereof, or en route thereto, in the war with that Nation, which service was as follow: He enlisted in Capt John Scantland Company B in 1847 went to Mexico and died in March 1848 while in the service and the line of duty and was honorably discharged at ______________ on or about the __________ day of _____________ A. D. 184_.

No. 4. That I am 69 years of age, and that I was born on or about the 7th day of January, 1819, at Jackson County, in the State of Tennessee.

No. 6. That I claim pension by reason of the fact that I am dependent in whole or in part upon others than those legally bound for my support.
That in support and proof of my right to pension I will hereafer submit evidence required under the regulations prescribed by the Secretary of the Interior.
That I have made heretofore made application for pension or bounty land, which said claim is No. do not recolect the no drew a land warrant for 160 acres
That since the death of my husband I have resided at the following places, to wit: near Gainesboro in the county of Jackson, State of Tenn. My present post-office address is Gainesboro county of Jackson and State of Tennessee.
That I am not labor in under any political disabilities imposed by the fourteenth amendment to the Constitution of the United States.
I hereby constitute and appoint, with full poser of substitution and revocation Wm. M. Pickett of Gainesboro, my true and lawful attorney to prosecute my claim.

Wheeler aged 56 years of Gainesboro Tenn and L. M. Cason aged 49 years of [age] Gainesboro Tenn well known to me to Respectable and Entitled to ???? who first being duly sworn depose as follows (to wit) Afficiants have been well acquainted with Sarah Rector for some 40 years have lived in the same county and Neighbourhood of Claimant ever since her marriage to Richard P. Barks. Sarah Rector and R. P. Barks lived together as man and wife But a verry short time after their said marriage. Barks fled from the country and affiants knows nothing of his whereabouts Sarah Rector has never resumed marriage relation with any one else since her marriage to Richard P. Barks. Afiants acquaintance with Sarah Rector is and has been such that if she had resumed marriage relation with any one else the fact would have been known to us. Sarah Rector is known and recognized as the Lawful widow of David M. Rector decd by the community in which she lives. Affiants further declares that they have no interest direct or indirect in this claim and they make the foregoing statements from personal knowledge.

Richard P. Barks} Decree
Be it remembered that this cause came on to be further heard upon petitions. When it appeared to the court form proof that Sarah Rector was married to one Richard P. Barks in 1854 and it further appeared to the court that the said Richard P. Barks had a living wife at the time of said marriage from whom he had no divorce which fact was unknown to the said Sarah Rector at the time of her said marriage. It further appeared to the court from proof that the said Richard P. Barks was indicted for Bigamy and he run a way and has not been heard of since, It is therefore ordered adjudged and decreed by the court that said marriage of Richard P. Barks to Sarah Rector be declared null and void and for mother held and she be declared the legal widow of David M. Rector deceased.

In the matter of claim for pension of Sarah REctor widow of David M. Rector widow of David M. Rector decd personally appeared before me J. H. Chaffin Clk of the County Court for said County & State William Gore aged 63 years of age who being duly sworn according to law depose as follows (to wit) affiant was personally acquainted with David M. Rector in his life time David M. Rector was a member of Company B commanded by Capt John Scantland in 4 Tenn Ridgement commanded by Richard Waterhouse in the war with Mexico. David M. Rector died in Mexico in 1848 while in the service and line of duty. Affiant knows that Sarah Rector and D. M. Rector was living together as man and wife when the soldiers went into the service in the war with Mexico. Affiant further states that he is not interested in the prosecution of this claim. This the 24 day of January.
